THE CONSTITUTIONAL ROLE OF THE SUPREME COURT OF THE REPUBLIC OF MACEDONIA SEEN THROUGH THE PRISM OF THE RULE OF LAW PRINCIPLE
Abstract
The article focuses on the provisions of the Judiciary Act relating to the principal standpoints and
legal opinions as tools which the Supreme Court of Republic of Macedonia uses to practice its
constitutional role in providing uniformity in the application of laws by the courts. The
methodological instrument applied to the analysis is the Rule of Law Checklist adopted in March
2016 by the Venice Commission within the Council of Europe. Legal certainty, legality and
independence of judges are the parameters by which the compliance of those legal provisions to
the Rule of Law principle is being assessed.
